New West Virginia Trucking Law
New West Virginia Trucking Law
Commercial trucking companies play a key part in the nation’s economy. Unfortunately, the massive vehicles that are required to haul so much cargo produce a large output of carbon emissions and can have an undue impact on environmental air quality.
There are regulatory changes pending that will radically alter the emissions requirements in the coming years, but some locales are taking steps to limit the effect that big rigs will have on their air in the present. For example, on June 1, 2010, West Virginia passed a law restricting the length of time that diesel-powered trucks of a certain size are permitted to idle.
The freight factoring professionals of TBS Factoring Service, LLC understand that you are concerned about the environmental impact of your small trucking fleet. Slow-paying or nonpaying clients can interfere with your ability to make desired and mandated retrofits and upgrades. We can help you to avoid being caught behind the times and subject to fines. Key Terms of the New Law
Commercial vehicles with a gross weight of 10,000 pounds or greater cannot idle in excess of 5 minutes per hour under the new law. Exceptions outlined by the law include:
- Idling under the instruction of a police officer or state trooper
- Idling in gridlocked highway traffic or a prolonged stop at a traffic light
- Idling as necessary for promoting safety, such as to enable defrosters, heaters, and refrigeration units to function
If your drivers are going to be traveling to or through West Virginia, they will need to be aware of the limitations imposed by the new law or your company could be saddled with $150 – $300 citations in addition to court costs.
