The Code of Federal Regulations, or CFR, refers to a set of rules governing motor vehicles engaged in interstate trade. Specifically, they refer to laws enumerated in the Federal Motor Carrier Safety Regulations. In particular, 49 CFR 382 applies to controlled substances and alcohol testing, and is designed to prevent impaired truck drivers from injuring people on the roads.

Understanding Testing Laws
Under 49 CFR 382, companies are required to set up testing programs to help ensure that drivers are not impaired while operating their vehicles. Additionally, owners and operators of trucking companies must comply with national testing standards.
According to the law, employees must be tested if they drive a commercial vehicle that meets any of the following criteria:
- The vehicle must weigh more than 26,000 pounds, including a towed unit weighing at least 10,000 pounds
- The vehicle must have a gross vehicle rating of more than 26,000 pounds
- The vehicle is meant to transport 16 or more people, counting the driver
- The vehicle is used to transport designated hazardous materials
There are serious repercussions for failing to regularly test drivers for controlled substances and alcohol.
